The city of Fruita is one step closer to getting its first medical marijuana dispensary.
Tuesday night the city planning commission unanimously approved the business called Next Gen.
The next hurdle for the center is the Fruita City Council.
Tuesday’s meeting with the planning commission was to make sure that the center followed regulations for zoning and approving a conditional use permit.
The proposed site is currently an empty office building at 1960 Highway 6 and 50.
Regulations passed in November of 2009 say that a dispensary has to be 1,000 feet from a school or daycare, 250 feet from parks and public recreational facilities and 250 feet from residential land use.
The commission found Next Gen follows that criteria.
“The job of this commissions is to make sure that they have gone through the proper format and meet all the requirements in order to meet land use code and city staff’s reccomendations,” said Tim Grimsby, Fruita Planning Commissioner.
A couple local business owners expressed their concerns about the center’s location. Next Gen says they’re committed to working things out with their neighbors.
“It’s one of those things that it’s important to address people’s concerns and figure out where they’re coming from and why,” said Aaron Norris, attorney for Next Gen, “and make sure that Next Gen is doing everything possible to address those concerns.”
This past April, Fruita became the first town in the state to approve a medical marijuana sales tax which stands at 5%
The permit will be good until July 30th, pending state approval.
Next Gen is the only medical marijuana dispensary that made the deadline for applying for a permit.
The Fruita City Council will hold a public hearing for final approval on October 5th.
